Question 1

Section A, Income-tax Law, and Section B, Goods and Services Tax, share a cover, a mark allocation and an examination sitting, but they share almost nothing substantive: different vocabulary, different underlying logic, different computation formats, and different sources of authority. Income-tax turns on heads of income, deductions and slab-based computation of an individual's or entity's total income for a year; GST turns on the concept of supply, place and time of supply, and a transaction-by-transaction levy. A candidate who is strong in one and vague in the other typically lands near the pass mark rather than comfortably above it, because fifty marks of genuine weakness in one section cannot be rescued by fifty marks of strength in the other; the paper does not average across sections in a way that lets one half compensate. The commonest planning error is to let GST, whose logic is more mechanical and whose problems resolve into fewer patterns, absorb disproportionate preparation time simply because it feels more masterable, while Income-tax Law, which is genuinely larger in scope, receives correspondingly less. The corrective is to budget hours and revision cycles for the two sections independently from the outset, as though preparing for two separate papers that happen to share an answer sheet.

Question 2

Set out the eight-stage skeleton every income-tax computation follows, and explain why writing it as a staged, headed statement earns marks independently of the arithmetic.

Every income-tax computation resolves to the same sequence regardless of how the facts are dressed. First, income is computed under each of the five heads: Salaries, House Property, Business or Profession, Capital Gains, and Other Sources. Second, clubbing provisions are applied, including in the assessee's total income any income of another person that the law attributes to him. Third, the heads are aggregated to Gross Total Income. Fourth, set-off and carry-forward of losses are applied. Fifth, Chapter VI-A deductions are subtracted to arrive at Total Income. Sixth, tax is computed on Total Income at the applicable rates and regime. Seventh, rebate, surcharge and cess are adjusted for. Eighth, advance tax and TDS or TCS already paid are adjusted against the tax liability. Writing this as a staged, headed statement earns marks independently of whether every figure is right, because ICAI's own suggested answers are laid out exactly this way, and an examiner marking a large volume of scripts against a scheme finds and credits each stage where it is visibly presented; a computation with a correct final figure but no visible staging is marked as though the reasoning behind it cannot be seen, because in practice it cannot.

Question 3

State the four-question sequence for any GST problem, in order, and explain why the order matters rather than being merely a convenient checklist.

Accepted Answer

The four questions are: is this a supply; is it taxable, or exempt, or excluded as a non-supply under Schedule III; when does the liability arise, that is the time of supply; and on what value and at what rate. The order matters because each answer depends on the one before it rather than being independently determinable. If the transaction is not a supply at all under section 7, no further question in the sequence has any purpose, since nothing else in the Act is engaged. If it is a supply but exempt, or falls within Schedule III as neither a supply of goods nor of services, the time of supply and valuation questions become irrelevant to computing any tax, though they may still matter for other compliance purposes. Only once a transaction is confirmed to be a taxable supply does asking when the liability arises make sense, since time of supply fixes the return period in which an otherwise-established liability must be reported. And only once the time of supply is fixed can the applicable value and rate, which can themselves change over time through amendment, be correctly identified as those in force at the relevant point. Working the questions out of order risks computing a value and rate for a transaction that turns out not to be taxable at all, wasting the working and risking a wrong conclusion being carried forward with false confidence.

Question 4

A candidate preparing for the September 2026 sitting is using a course rewritten for the Income-tax Act, 2025. Advise on the risk, and state precisely when each Act governs.

Accepted Answer

The candidate is at serious risk of studying from the wrong statute entirely. Section A of Paper 3, Income-tax Law, is examined on the Income-tax Act, 1961 for the May 2026, September 2026 and January 2027 examination sittings. The Income-tax Act, 2025, which received Presidential assent on 21 August 2025 and takes effect from 1 April 2026 governing the tax year 2026-27, becomes examinable in CA Intermediate only from the May 2027 sitting onward. A candidate sitting in September 2026 who studies from material rewritten for the 2025 Act will learn a different set of section numbers, a different structural presentation, and in places different terminology for concepts that carry over in substance, and will be unable to cite the provisions ICAI's examiners and suggested answers use for that sitting, even where the underlying legal position is unchanged. The practical advice is to check the applicability line printed on the cover of any book, course or set of notes before relying on it — ICAI's own study material states clearly which Act and which assessment year it is written for — and to prefer ICAI's official study material with its published statutory updates over third-party material of uncertain vintage. A candidate sitting after May 2027 faces the identical risk in reverse: relying on material still written for the 1961 Act will mean citing sections that no longer correspond to the applicable law.

Question 5

Explain why a running threshold table matters more in this paper than the volume of material might suggest, and how it should be organised.

Accepted Answer

Both halves of Paper 3 are drafted around thresholds — turnover limits for registration and composition under GST, monetary limits for deductions and exemptions under Income-tax Law, time limits for filing and payment, percentage limits governing rates of TDS and various allowances — and more marks in this paper turn on getting a threshold precisely right than on any other single category of knowledge. The reason a threshold error is more damaging than an ordinary computational slip is that it does not merely produce a wrong number in one line; it changes which regime, which exemption, or which registration requirement applies at all, and every subsequent figure in the computation is built on that wrong foundation. A candidate who misremembers a rate produces one wrong figure; a candidate who misremembers a threshold produces a wrong computation from the first line onward. The table should be organised by kind rather than by chapter, exactly as recommended for the Companies Act in Paper 2: every turnover and registration limit grouped together, every time limit for filing or payment grouped together, every percentage limit for TDS, deductions or exemptions grouped together. Held that way, the entries are recalled by the kind of question being asked rather than requiring the candidate first to recall which chapter a particular threshold belonged to, which is the retrieval structure that survives under examination time pressure.

Question 6

A candidate finds Section A's first question going well and is tempted to keep refining the answer beyond its allotted time. Advise on the correct time discipline for this paper, and explain the reasoning.

Accepted Answer

The candidate should stop at the time budgeted for that question, however well it is going, and move on. A defensible allocation across the three-hour paper is roughly eighty minutes on Section A, eighty minutes on Section B, and the remaining time on the thirty-mark objective section that spans both, leaving a small margin for review. The reasoning that governs the discipline is the same principle that applies across every paper in this qualification: the marginal mark on a question already being answered well is worth less than the first mark on a question in a section not yet touched, because marks per minute fall sharply as an answer approaches completeness while they are highest at the very start of an unattempted question. A candidate who lets a strong opening question in Section A run fifteen minutes over its allocation does not gain fifteen minutes' worth of additional marks on that question, since most of what could be said has likely already been said, but does lose fifteen minutes that Section B needed, on which the marginal return would have been far higher. The specific risk in this paper is that Section A and Section B are so different in character that a candidate confident in one may unconsciously over-invest there and starve the other, which is precisely the planning error the two-papers-not-one framing exists to prevent.
